Real Estate Title Deed in Turkey

Registration of the transaction of purchase and sale of real estate in Turkey and the transfer of ownership of them is carried out in the Cadastral Office at the location of the acquired property.

The cadastral office is a state body that registers the ownership of housing, guaranteeing the verification and legality of the transaction.

What is Tapu in Turkey

This is an extract from the acts of registration in the cadastral book. According to Turkish Law, TAPU is the only legal document that confirms the untimely ownership of a particular property.

TAPU gives an absolute right of ownership of real estate, which cannot be challenged after the execution of the transaction of purchase and sale of real estate in Turkey.

The owner of real estate is an individual or legal entity whose name is inscribed directly in the TAPU, in which there are no age restrictions, and it is also possible to enter minor children. The TAPU act is certified by a stamp and transferred to the archive.

The 1st heading on the left side contains information about the property and the address (Taşınmaz bilgileri)

  • İl – Administrative center
  • İlçe – district, city
  • Mahalle is a neighborhood
  • Ada – cadastral number
  • Parsel – land plot (its number)
  • Yüzölçümü – plot area/dimensions
  • Niteliği – purpose of use: building, field, land

The 2nd on the left side consists of the information of the real estate unit (Bağımsız Bölüm)

  • Arsa payı – the share of the land plot owned by the property
  • Proje m² – the total area of the plot on which the house is erected
  • Blok/Giriş/Kat No – block/entrance/floor
  • Bağımsız Blm No – number of the apartment/house

The 3rd position is the column containing information about the owner (Malik bilgileri)

Adı Soyadı/Baba Adı – Name The surname of the owner(s) and his (their) father. More than 10 people can be registered in Tapu in Turkey. These can be relatives or strangers who are owners of equal or different shares of real estate.
Hissesi – share of ownership, the size of the share of ownership is determined by the buyers themselves. Each of the owners inscribed in the Tapu has the right to resell his share, the only thing is to obtain the consent of all other owners registered in Tapu.

The 4th position is located in the column on the registration of real estate (Tescile ilişkin bilgiler)

  • Taşınmaz Tipi/No – type of property/number
  • Edinme Sebebi – by whom and to whom the property is sold, the basis for the sale
  • Tescil Tarihi – registration date
  • Bedeli – the official value of the property. The price is indicated in Turkish lira and ranges from 40-60% of the real (market) value.

A new rule!

Since March 4, 2019, the General Directorate of Land Registry and Cadastre of Turkey has introduced state amendments.

It has become necessary for a foreign real estate purchase and sale transaction to conduct an independent expert assessment of the acquired real estate.

At the moment, this is the main requirement when applying for the renewal of a certificate of ownership of real estate in Turkey. Thus, the Turkish government is trying to legally protect non-residents of the country from fraudulent housing registration transactions. This measure also protects foreigners from buying real estate in Turkey at a reduced or overpriced price.
